The Style of the Jurists in Inferring Issues from the Sunan al-Taqririyyah
Abstract
The style of the jurists is an important topic in the issues derived from the Sunan al-Tawrith, in which the method of the jurists is described as to how they solve the Shariah issues regarding the words and actions presented to the Messenger of Allah, may God bless him and grant him peace. Inferred. Sunan al-Wawratiyah refers to those hadiths in which an action or a statement was presented to the Messenger of Allah, peace and blessings of Allah be upon him, and he did not object to it, which is considered to be the silent consent of him. The jurists first examine whether the action or speech presented to the Messenger of Allah ﷺ is in accordance with the Shariah principles or not. If the Prophet ﷺ remained silent on it, then the jurists consider it to be valid. The jurists also consider whether the order of Sunan al-Rawtiyyah is general or special. If it is for a special occasion, caution is exercised in its general application. The jurists compare the Sunan al-Rawtiyyah with other hadiths and jurisprudential issues to remove any possible contradictions or disagreements. If a problem does not emerge directly from the Sunan al-Rawtiyyah, the jurists infer from it through consensus and inference. This style shows the depth of knowledge of the jurists and their grasp of the Shariah principles, and thereby solves the problems of Islamic jurisprudence. It is deduced very carefully and meticulously.
Any student receives the blessings of knowledge from his teacher in three ways. First, he listens to the words of his teacher and follows them. Secondly, he carefully observes the actions of his teachers and mentors and imitates them. As a mediator, he takes the company of his teacher and mentor and performs various matters in front of his eyes. This third type is termed speech. The Messenger of Allah (peace and blessings of Allah be upon him) also used these three methods for reforming and training the Companions. In the chapter under review, it is intended to discuss the three dimensions of the Sunnah, i.e. the aspect of speech and action, and it is desirable to follow the opinions and styles of the jurists in this regard. The word Prophetic Speeches or Prophetic Confessions is usually used for Sunan speech.
