Abstract

From an Islamic perspective, crimes are viewed through the lens of divine law and morality with the Qur'an and Hadith serving as the primary sources. Islamic jurisprudence divides crimes into different classifications, which reflect the severity of crimes and their impact on individuals and society. The two main types are limits and tazeer. Huddah crimes are considered the most serious and include crimes such as theft, adultery, apostasy, and false accusations of adultery. These crimes have fixed punishments that are considered mandatory and are directly derived from the Qur'an and Hadith. Penal crimes, on the other hand, cover a wide range of crimes and are subject to discretionary punishment by judges or authorities. The objective of Islamic law is not only to prevent criminal behavior but also to promote justice, compassion and welfare of individuals and society as a whole. Understanding these classifications and their underlying principles is crucial to understanding how Islamic jurisprudence approaches crime and punishment. Crimes in Islam are not only violations of social norms but also against divine law and morality. The classification of offenses in the limits and punishments reflects the commitment of the Islamic legal system to uphold justice by taking into account the unique circumstances of each case. Hudud crimes, as described in the Qur'an and Hadith, come with specific, fixed punishments that serve as a deterrent and a means of upholding justice. These punishments are considered necessary to protect the moral foundations of society and protect individual rights. However, their application is subject to strict conditions and procedural safeguards to prevent wrongful convictions. Penal crimes, on the other hand, enable judges and authorities to consider the circumstances and intentions of the offender. This discretion is particularly important when dealing with crimes that are not expressly mentioned in religious texts. This allows for a more critical approach to justice and rehabilitation.
